WWho processes your personal data?
Flanders Innovation & Entrepreneurship (VLAIO) is an internal privatised agency of the Flemish Government, established by the Decision of the Flemish Government of 7 October 2005 regarding Flanders Innovation & Entrepreneurship. VLAIO is the point of contact within the Flemish Government for all entrepreneurs in Flanders. We promote and support innovation and enterpreneurship and contribute to a favourable entrepreneurial climate.

Team Bedrijfstrajecten (Business Processes Team) is a not-for-profit association which acts as the front office of VLAIO and as an active navigator in the network of service providers connected with VLAIO. The Flemish Government participates in this not-for-profit association on the basis of Article 14/1 of the Decree of 30 April 2009 Article 14/1 of the Decree of 30 April 2009 regarding the organisation and funding of science and innovation policy.

Why do we process your personal data?
VLAIO and/or Team Bedrijfstrajecten process your personal data for the tasks set out below. These processing operations are necessary::
- for complying with a legal obligation (see Article 6 paragraph 1 under c of the General Data Protection Regulation); or
- for the performance of a task carried out in the public interest or in the exercise of official authority vested in VLAIO and/or Team Bedrijfstrajecten (see Article 6 paragraph 1 under e of the General Data Protection Regulation).
All essential elements of these personal data processing operations have been included for each task in the VLAIO GDPR Decree.
Task: providing support on the basis of the regulations on economic support policy, the regulations on spatial economy, the regulations on inconvenience compensation for public works, the regulations on the Innovation and Entrepreneurship Fund and support provided on behalf of the European Commission, the Flemish Government and the competent minister, including guidance towards support, monitoring compliance with support regulations and the recovery and repayment of support, administrative appeals, and recognitions or registrations granted to service providers.

Retention period: 10 years after the file has been closed or the activity has been completed, except for the personal data relating to recognised qualifications and recognised learning and experience certificates or learning and experience certificates declared equivalent to them, and the associated minimum identification details of the data subject, which are retained for a period of 110 years after the data subject’s birth.
Task: developing and implementing spatial economic policy on the basis of the regulations on spatial economy, including the brownfield covenant policy on the basis of the brownfield covenant regulations.

Task: organising itinerant and fairground activities and maintaining them on the basis of the regulations on itinerant and fairground activities.

Task: Aggregating personal data in a centralised database through data mining, data matching and data analysis, including profiling, for the performance of the following tasks:
- monitoring compliance with the support regulations mentioned in the first purpose, for the detection of profiles with an increased risk;
- policy-supporting tasks;
- answering questions.

Members of staff of VLAIO and Team Bedrijfstrajecten have access to your personal data if this is necessary for the tasks they perform.
The processing of your personal data concerning health, racial, ethnic or judicial data, mentioned in this statement, is regarded as necessary for reasons of a compelling public interest.
A longer retention period for your personal data than that stated above is possible if required by or pursuant to a law, decree or European regulation. After expiry of the retention period, further retention may be required for archiving in the public interest, for scientific or historical research, or for statistical purposes. VLAIO establishes a selection rule for each category of administrative documents and for the personal data contained in them. This selection rule sets out the exact retention period and the final destination. Are your personal data secured?
VLAIO and Team Bedrijfstrajecten take all reasonable measures to prevent misuse, loss, unauthorised access and other undesirable actions involving your personal data. To this end, we implement appropriate technical and organisational measures. Our approach is based on the information classification framework of the Flemish Government and on our legal obligations under the NIS2 Act. In concrete terms, this means that we use encryption of your personal data, strong authentication and access logging. In the event of an incident involving your personal data, we will inform you in accordance with the legal provisions and our internal procedures.
Do we treat your personal data confidentially?
We recognise the potentially sensitive nature of your personal data. That is why we treat them with the highest level of confidentiality. All employees and all persons we cooperate with are bound by strict confidentiality obligations. We do not share your personal data with third parties other than those described below, unless you have given prior consent.
Who do we share your personal data with?
VLAIO and/or Team Bedrijfstrajecten may share your personal data with other public authorities or private organisations. We conclude a protocol or an agreement with these authorities or private organisations to ensure that your personal data are processed in accordance with the relevant privacy regulations. We generally do not transfer your personal data to countries outside the European Economic Area or to international organisations. Should this occur by way of exception, we will ensure that your personal data are protected as effectively as possible.
Will we disclose your personal data?
We will not in principle disclose your personal data, unless the VLAIO GDPR Decree permits us to do so. At present, VLAIO, as controller, may disclose personal data on its website in the context of the tasks listed below.
Task: transparency and sound management concerning the use of financial resources granted on the basis of the support regulations
Categories of personal data:

- financial details (e.g. amount of support granted, date of granting).
Categories of data subjects:
- natural persons who independently exercise a professional activity;
- prospective entrepreneurs.
Task: identifying synergies and opportunities for cooperation between project proposals submitted in preparation for granting support
Categories of personal data:
- identification details (e.g. company registration number, name);
- financial details (e.g. amount of support granted, date of granting);
- profession and employment (e.g. job title, current employer).
Categories of data subjects:
- natural persons who independently exercise a professional activity;
- prospective entrepreneurs;
- natural persons connected with an enterprise;
- natural persons connected with a public authority;
- representatives of the persons mentioned in the previous points.
Task: transparency regarding the agreements laid down and sound management of financial resources on the basis of the brownfield covenant regulations.
Categories of personal data:
- identification details (e.g. company registration number, name);
- financial details (e.g. assets, agreements, settlements);
- profession and employment (e.g. job title, current employer);
- lifestyle (e.g. public mandates).
Categories of data subjects:
- actors and directors in a brownfield covenant;
- negotiators in a brownfield covenant;
- representatives of the persons mentioned in the previous points.
Furthermore, other regulations also require VLAIO to disclose personal data for the tasks listed below.
Task: transparency and sound management concerning the use of financial resources granted on the basis of the General Block Exemption Regulation via the State Aid Transparency Award Module (TAM)
Categories of personal data:

Task: transparency and sound management concerning the use of financial resources granted on the basis of the De Minimis Regulation via the eAid Register

- natural persons who independently exercise a professional activity;
- prospective entrepreneurs.
What are your rights?
You can retain control over the processing of your personal data by exercising the following rights:
- Right of access: You have the right of access to all personal data that we process about you.
- Right to rectification: If the personal data we hold about you are inaccurate or incomplete, you have the right to have them rectified or supplemented.
- Right to erasure: You have the right to request the erasure of your personal data.
- Right to restriction of processing: You have the right to restrict the processing of your personal data.
- Right to data portability: You have the right to receive your personal data from us, or to have them transmitted to another controller.
- Right to object: If you believe your personal data should no longer be processed due to your specific situation, you may object to such processing.
- Right to withdraw your consent: If we process your personal data on the basis of any consent you have given, you may withdraw that consent at any time.
VLAIO and Team Bedrijfstrajecten do not use automated decision-making within the meaning of Article 22 of the General Data Protection Regulation. The Flemish Government may, under certain conditions, authorise VLAIO to do so, but no such authorisation currently exists.
How can you exercise these rights?
If you want exercise the above rights, you can contact our Data Protection Officer (DPO) via dpo@vlaio.be.
Indicate which right you want to exercise and how you would like to receive the information. Occasionally we will request additional information to identify you correctly. In most cases, our DPO will provide a response within 1 month. Sometimes we extend this period to a maximum of 3 months. In that case we will inform you of the reason for this extension within the first month.
Depending on the processing and its legal basis, conditions or limitations may apply to the exercise of your rights. For example, VLAIO may restrict your rights during an investigation relating to:
- economic regulation and pricing (see Article 7a of the Act of 22 January 1945 on economic regulation and pricing);
- the exercise and organisation of itinerant and fairground activities (see Article 11, Section 4 of the Act of 25 June 1993 on the exercise and organisation of itinerant and fairground activities);
- the integrated trading establishment policy (see Article 15, Section 5 of the Decree of 15 July 2016 on the integrated trading establishment policy).
How can you submit a complaint?
If we cannot resolve the matter together and you disagree with how VLAIO and/or Team Bedrijfstrajecten process your personal data, you can submit a complaint to a supervisory authority. For example:
